UNFAIR COMPETITION INVESTIGATIONS

Our intervention, operating throughout the country, makes it possible to carry out all the necessary investigative activities to document wrongdoing in cases of unfair competition.

Our task, which can be developed throughout the country by putting in place all the necessary investigative activities, is aimed at documenting offenses committed in cases of unfair competition (e.g., disloyalty of partners, associates, managers or directors, new activities carried out in competition whose real owners are hidden behind Italian or foreign trusts, actions to trademark or patent protection, labor misappropriation, etc.) to the detriment of the Client. This evidence will be contained in an investigative report that can be used in court and possibly supported by the testimony of the licensee as well as our employed and legally authorized operating personnel.

Unfair competition, regulated by Articles 2589 et seq. of the Civil Code, occurs mainly in the following cases:

  • Use of distinctive names or signs that create confusion with the names and signs of another company (confusability)
  • Imitation of the shape and appearance of a competitor’s products
  • Activities that create confusion with a competitor’s products and business
  • Dissemination of disparaging news and appreciation of a competitor’s products or business
  • Appropriation of specific merits of competitors’ products
  • Violation of the principles of professional fairness that harm the competing company (e.g., industrial espionage, boycott, employee diversion, violation of public policy, etc.)
