Specifically, the patent, confers on the holder:
- where the subject matter of the patent is a product, the right to prohibit third parties, except with the consent of the owner, from producing, using, marketing, selling or importing for such purposes the product in question,
- where the subject matter of the patent is a process, the right to prohibit third parties, except with the consent of the owner, from applying the process, as well as from using, marketing, selling or importing for such purposes the product directly obtained by the process in question.
It is important to note that a patent does not give the owner “freedom of use” or the right to exploit the technology covered by the patent, but only the right to exclude other parties from using it.
