DETERMINATION AND REVALUATION OF MAINTENANCE ALLOWANCE

Article 156 of the Civil Code stipulates that in the case of marital separation, it is the court that, once the economic capacity of the two parties has been ascertained, including on the basis of their standard of living, decides on the extent of any maintenance allowance to be paid by one of the spouses if a possible separation with objection is considered.

The amount determined by the judge will be, over the years, subject to re-evaluation in the event that a change in the income capacity of either party is proven.

In this area, our investigative agency carries out in-depth activities throughout the country aimed at reconstructing the real economic capacity or income situation of the former spouse by going to document, within an investigative report that can be produced in court, also the presence of any “unofficial” sources of income (example, real standard of living verification, verification of “unofficial” work activities, cohabitation, etc…).
